This User Agreement (“Agreement”) is a legally binding agreement between you (“User”) and I-Bid Auction (“Platform”, “we”, “our”, or “us”). By registering for, accessing, browsing, or using the Platform, you agree to comply with and be bound by the terms of this Agreement, along with our Privacy Policy and any other policies incorporated herein.

1. Eligibility
   1. To register as a User on the I-Bid Auction platform, you must be at least 18 years old and capable of forming a legally binding contract.
   2. We reserve the right to refuse or terminate your registration or use of the Platform at our discretion.
2. Account Registration and Use
   1. To participate in auctions, you are required to create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account and password.
   2. You agree to notify I-Bid Auction immediately of any unauthorized use of your account or breach of security. I-Bid Auction will not be liable for any loss arising from the unauthorized use of your account.
3. Auction Process
   1. Bidding: Users can place bids on items listed on the Platform. Each bid is a binding offer to purchase the item.
   2. Winning Bids: When you submit the highest bid and the auction closes, you agree to purchase the item at the final price you offered. Winning an auction constitutes a legally binding contract between you and the seller.
   3. Reserve Prices: Some auctions may have reserve prices, which are the minimum price the seller is willing to accept. If the reserve price is not met, the item will not be sold.
4. Fees and Payments
   1. Registration Fees: I-Bid Auction may charge fees for registering or participating in auctions. These fees will be clearly disclosed prior to your registration or participation.
   2. Commission and Seller Fees: Sellers may be required to pay listing or commission fees on completed sales. These fees will be detailed in your seller agreement.
   3. Payment Methods: Payments must be made through the Platform’s approved payment methods. You agree to pay all fees and charges incurred in connection with your transactions.
5. User Conduct
   1. You agree not to engage in any fraudulent, misleading, or deceptive behaviour while using the Platform.
   2. You must comply with all applicable laws, including laws related to intellectual property, privacy, and the sale of goods.
   3. I-Bid Auction reserves the right to suspend or terminate your account if you violate any terms of this Agreement.
6. Item Listings and Descriptions
   1. Sellers must provide accurate and complete descriptions of items for sale. Misrepresentation of items is prohibited.
   2. I-Bid Auction does not guarantee the accuracy or authenticity of item descriptions, and the buyer accepts the responsibility to verify item details before bidding.
7. Shipping and Delivery
   1. Sellers are responsible for shipping items to winning bidders in a timely manner as per the agreed shipping terms.
   2. Buyers must ensure their shipping information is accurate and agree to pay any applicable shipping charges.
8. Dispute Resolution
   1. Buyer and Seller Disputes: I-Bid Auction encourages Users to resolve disputes directly. If a resolution cannot be reached, you may contact I-Bid Auction for mediation. However, I-Bid Auction is not obligated to resolve any disputes.
   2. Consumer Protection Laws: In accordance with the South African Consumer Protection Act (CPA) and other applicable legislation, consumers have certain rights related to purchases, such as the right to fair and honest dealings, product safety, and consumer privacy. Any disputes arising from transactions must comply with these laws.
   3. Binding Arbitration: Any disputes arising under this Agreement that cannot be resolved through mediation will be submitted to binding arbitration in accordance with South African laws.
9. Limitation of Liability
   1. I-Bid Auction is not responsible for the quality, safety, legality, or availability of items listed by users.
   2. To the fullest extent permitted by law, I-Bid Auction shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Platform.
10. Termination
    1. I-Bid Auction reserves the right to terminate your account or access to the Platform at any time, without notice, for any reason.
    2. You may terminate your account by providing written notice to I-Bid Auction. Upon termination, you will remain liable for any outstanding fees or payments.
11. Privacy
    1. We value your privacy and will protect your personal data in accordance with South Africa’s Protection of Personal Information Act (POPIA) and our Privacy Policy, which is incorporated by reference into this Agreement.
12. Amendments
    1. I-Bid Auction reserves the right to modify this Agreement at any time. Changes will be posted on the Platform, and continued use of the Platform constitutes acceptance of the updated terms.
13. Governing Law
    1. This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law provisions.
    2. Any legal proceedings arising from this Agreement shall be brought in the courts of the Republic of South Africa.
